Case Against Already Banned Publication

Public prosecutor's office on press filed a case against Kaos Gay and Lesbian Cultural Studies and Solidarity Foundation's publication Kaos GL's owner Umut Güner at the Ankara 2nd Court of First Intance.

Prosecutor Nadi Türkaslan claimed that a photograph published on the banned issue on pornography is obscene and can't be evaluated as art.

Güner will be tried with the Penal Code article 226/2 for up to 3 years imprisonment. The article formulates the crime of "dispersion of obscene writings, images and publications via press".

The issue in question was banned by court order and collected from the vendors on July 24. The association had put the case to the European Court of Human Rights (ECHR).

"That issue included a critism against the ponography industry" said Güner.

He remarked that the issue never met with public therefore it's impossible to claim that it degraded public morality.

"This is a non-existing case and it's a violation of our freedom of expression", Güner added.(AÖ/KÖ/EÜ)
