Council of Europe requests a report on ECtHR judgements from Turkey

The Council of Europe (CoE) Committee of Ministers, acting in supervisory capacity for the European Court of Human Rights (ECtHR) judgments, has requested that Turkey submit a report regarding 15 cases and to document whether a retrial/re-investigation began following the rulings of right violation and whether the limitation period has expired in the related cases.

Sending an official letter to the Ministry of Justice Department of Human Rights and to the related Chief Public Prosecutor's Offices, the Committee of Ministers has requested information as to the case files where the ECtHR concluded that there had been a violation of right.

The related 15 cases are reportedly about the incidents of ill treatment and violations of right to life that fall within the state's responsibility; these also include the death of applicants' relatives and the incidents of ill treatment that occurred during the transfer of prisoners.

Some cases are also about the lack of an effective investigation against law enforcement, the cases dropped due to statutory limitations, the mildness of sentences and the failure to suspend the investigated persons from duty.

Accordingly, the official letter sent to the Ministry of Justice and the Chief Public Prosecutor's Offices has reminded the authorities that "the Committee of Ministers supervises the execution of the European Court of Human Rights (ECtHR) judgements" and requested information whether a retrial/re-investigation began following the judgements of right violation and whether the limitation period has expired in the related cases.

Among the cases about which the Committee of Ministers has requested information are also the ones where no retrial has been held despite the ECtHR judgements of right violation or the cases which have dropped due to the violation of statutory limitations. (HA/SD)
